PT. YELOW OLAHKATA APPLICATION (“KONTAKAMI” or “we”) is the content owner and operator of the https://kontakami.com website, related sites and microsites accessed through such website and the KONTAKAMI application and any services provided therein and such other services as KONTAKAMI may make available from time to time (collectively the "Services").

We value the privacy of personal data and information, as a Customer and subscriber to the Service ("Customer", "You"), and are committed to protecting your data and information. This privacy policy explains how we collect, process, use and disclose your data and information ("Privacy Policy"). Any Personal Data that has been set out on this Service is reserved exclusively for the KONTAKAMI Service. This page provides you with an explanation of KONTAKAMI's policy regarding the collection, processing and disclosure of Personal Data for the KONTAKAMI Service.

We designed this Privacy Policy to explain to you how we collect, use and share your personal information. "Personal information" means any information that can be used to personally identify you (excluding any information that has been aggregated or made anonymous) and as interpreted under the Minister of Communication and Information Technology Regulation No. 20 of 2016 on the Protection of Personal Data in Electronic Systems (hereinafter referred to as "Regulation 20/2016").

KONTAKAMI uses your Personal Data only for the needs of developing and improving the quality of KONTAKAMI Services or other needs that are reasonable and do not conflict with applicable laws and regulations in Indonesia. By providing this Personal Data, you agree to the collection and violation of the information contained in this Privacy Policy for KONTAKAMI Services.

You understand that in order to provide the best Service for you, KONTAKAMI may integrate the Service with third-party systems, applications, or software integrated with the Service, or other products, services, or businesses owned by third parties. Given that such third-party systems, applications, or software may have different privacy policies, we advise you to read such privacy policies before using the Service integrated with third-party systems, applications, or software. You also understand that Customer Information (as defined below) that may be disclosed to such third-party partners under this Privacy Policy, once disclosed, will be beyond KONTAKAMI's control.

You must read this Privacy Policy before registering and using the Service. By registering and using any of our products and/or Services, you represent that you have read, understood, and agreed to the terms of this Privacy Policy.

Collection and Use of Information

KONTAKAMI reserves the right to collect information when the Customer registers for a KONTAKAMI account, when the Customer provides information as part of the identity verification process, when a transaction is made, or when the Customer requests a digital receipt. KONTAKAMI reserves the right to collect, but is not limited to collecting the following:

General Customer data or information, such as name, email address, office address, telephone number, and date of birth;
Identification, including identification card number;
Contact, including office address, billing address, shipping address, email address, telephone number, data of the contact person;
Financial information, including bank, bank account, credit card, and detailed financial information;
Transaction details, including payment details and sales documents to and from you, and other details related to the products and services you use or purchase from us;
Marketing and Communication preferences, including your preferences in receiving marketing materials and communications from us and our partners;
Any Data and Information uploaded by you or any information regarding your products and services;
Information that is attached to you when you access the Site, Application, and/or Services;
Any specific information from your system that is logged and collected automatically by KONTAKAMI using various types of tracking technologies, such as Internet Protocol address (IP address), unique device or user ID version of the software used, system type, date, time, and details of your transactions, geo tagging (geo-location), and information from your account provided to KONTAKAMI by you;

(All of the above types of information are hereinafter referred to as "Customer Information").

We reserve the right, from time to time, to verify the personal information you provide to us, by sending a verification letter, e-mail, or requiring you to submit supporting documentation, or any other means, as requested.

You hereby agree that your Personal Information may be disclosed to the following parties: (a) affiliates and subsidiaries, agents and subcontractors of the Company; (b) governments, regulatory agencies, and fraud prevention agencies for the purpose of identifying, preventing, detecting or combating fraud, money laundering, or other crimes, and for other lawful purposes; (c) other entities that may be required by law or as a matter of public interest to access information for the purposes described in the following paragraphs; and (d) purchasers or prospective purchasers in connection with acquisitions. You understand and realize that such disclosures must be made and agree to waive your right to make any claim in relation thereto.

Use of Personal Data

KONTAKAMI uses information about you to provide, maintain, and improve our services and to deliver the information and support you request, including receipts, alerts, and support and administrative advertising messages.

Customer Information and other information provided by you and, where relevant, for the use of, or subscription to, or purchase of our Services and/or products, including any additional information subsequently provided by you, may be used and processed by us for the following purposes:

Running our business and assisting us in providing, maintaining, and improving the Services;
Sending information and supporting KONTAKAMI requests, including receipts, reminders, support messages, and administrative messages;
Sending you news and information about the Services and communicating with you regarding products, services, promotions, and the latest information offered by KONTAKAMI and its designated partners;
Providing options regarding our use of information that suit you;
Providing a transparent and clear explanation of how we use that information;
Publishing or sharing aggregated information from several users and/or customers, while ensuring that neither you nor others can be identified;
Aggregating your uploaded account data and non-personal information so that you cannot be identified, with data from other Service users to improve service quality, design promotions, or provide a way for you to compare business practices with other users;
Obtaining and collecting Customer Information and storing Customer Information in an electronic system owned by KONTAKAMI or a third party;
Assessing and processing your requests regarding the Services;
Detecting and verifying your identity or background;
Establishing communication between KONTAKAMI and the Customer;
Processing your payment transactions related to the Services;
Responding to questions, complaints, or comments from you;
Managing the Customer's participation in events or programs organized by KONTAKAMI;
Managing and analyzing Customer Information, including conducting market analysis, whether performed by KONTAKAMI or a third party;
Displaying, announcing, and providing access to Customer Information to subsidiaries, affiliates, related companies, licensees, business partners, and/or service providers;
Investigating and preventing fraud or other illegal activities;
Conducting internal activities, including internal investigations, compliance, audits, and other internal security purposes;
Other legitimate business activities of KONTAKAMI; and
Any other purpose that will be disclosed to you in connection with the Services.

KONTAKAMI may use information about you to improve, customise, and facilitate the use of our services and products to provide better services.

Security of Personal Information

KONTAKAMI ensures that the information and/or Data collected will be stored securely. KONTAKAMI retains your personal information and/or Data for as long as necessary to fulfil the purposes described in this privacy policy.

We retain Customer Information, for as long as you are a customer or user of one of our products and/or services. We also retain Customer Information for a period of time after you are no longer a customer or user of any of our products and/or Services if the Customer Information is necessary for the Purpose for which the Customer Information was collected or to fulfil legal requirements.

You shall be responsible for maintaining the confidentiality of your own account and password, as well as any and all applications submitted, obligations approved or entered into, and all other activities performed under such account. You agree to notify us immediately of any unauthorised use or disclosure of your account or password, any unauthorised activity under your account, or any other breach of security.

We will not be liable for any loss you may incur as a result of third-party use of your account or password, whether with or without your knowledge, without any fault or negligence on our part.

Data from Third-Party Platforms (Meta)

Where a Customer connects their Meta assets, including but not limited to a Facebook Page and/or a Professional Instagram account, to the Kontakami service, Kontakami may receive, access, store, and process data provided through Meta's official Application Programming Interface (API) based on the authorisation granted by the Customer as the owner or authorised party of those assets.

Data processed may include, but is not limited to:

The identity of the Facebook Page and/or Professional Instagram account, including the name and asset ID;
The content of communications sent by end users to the Facebook Page and/or Professional Instagram account, including messages, attachments, and related metadata; and
Sender identity in the form of a Page-Scoped ID (PSID) or other identifier provided by Meta in accordance with Meta's applicable terms and policies.
Basic sender profile information provided by Meta in accordance with the authorised permissions, such as display name.

Kontakami processes such data solely for the purpose of providing Contact Center and Omnichannel services, including but not limited to receiving, storing, displaying, managing, assigning, monitoring, and responding to conversations received through Meta platforms.

Kontakami does not sell, trade, or disclose such data to third parties, except as necessary for the provision of the service, as required by applicable laws and regulations, or as described in this Privacy Policy.

Customers may at any time revoke authorisation or disconnect their Meta assets through the settings in the Kontakami application or through the Business Integrations feature on the relevant Meta account. All credentials and access tokens received from Meta are stored using adequate security mechanisms, including encryption, in accordance with applicable security practices.

Data Deletion

A Data Subject or Customer has the right to submit a request for the deletion of personal data processed by Kontakami, including data obtained through integration with Meta platforms, in accordance with applicable laws and regulations.

Data deletion requests may be submitted via email to support@kontakami.com — using the email address registered with the Kontakami service. Requests submitted by Data Subjects other than Customers must be accompanied by sufficient information to enable Kontakami to verify the identity of the requestor and trace the relevant data (for example, the account name and the page/account that was the destination of the communication).

Upon receipt of a valid and verifiable request, Kontakami will review and process the request within a maximum period of 30 (thirty) calendar days, unless required to retain certain data to fulfil legal obligations, resolve disputes, enforce agreements, for audit purposes, or for other legitimate interests permitted by applicable laws and regulations.

Kontakami will provide confirmation to the requestor once the data deletion process has been completed. Disconnecting an integration or revoking authorisation of a Meta asset will stop the collection and processing of new data from that asset, but will not automatically delete previously stored data. Deletion of previously stored data remains subject to the procedure set out in this section.

Applicable Law

Any reference to applicable laws and regulations under this Privacy Policy shall be construed in accordance with the provisions listed under the laws and regulations of the Republic of Indonesia. All problems will be resolved by deliberation first, where the disputing parties agree to settle it at the South Jakarta District Court if within 30 (thirty) days of the deliberation there is no consensus.

Changes in Privacy Policy

KONTAKAMI may disclose the information it collects in cases required by applicable law. To the extent permitted by applicable law, KONTAKAMI may disclose such information at the request of law enforcement agencies or other government bodies, or where KONTAKAMI feels that such disclosure may prevent a criminal offence from occurring, or may assist an investigation in relation to the safety of the public, to protect the security or integrity of the KONTAKAMI website, or to enable KONTAKAMI to take precautions against possible losses.

KONTAKAMI reserves the right to amend the privacy policy in accordance with KONTAKAMI's Terms & Conditions from time to time.
